Welcome to www.andersonhousefoods.com. The website (the "Site") is comprised of various web pages operated by K.M.J. Enterprises, Inc. doing business as Anderson House Foods ("Company," "we," "us," or "our"). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully.

  1. Electronic Communications

Visiting the Site or sending emails to us constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

  1. Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. We reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

  1. Products and Pricing

Anderson House Foods attempts to be as accurate as possible. However, we do not warrant that product descriptions, nutritional information, or other content of this site is accurate, complete, reliable, current, or error-free.

  • Pricing Errors: In the event a product is listed at an incorrect price due to a typographical error, we shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price, specifically including orders that have been confirmed and your credit card charged. If your credit card has been charged, we will issue a refund.
  1. Shipping and Returns Policy (Food Safety)

Because our products are food items, we do not accept returns of opened or unopened soup mixes for safety reasons.

  • Damaged Goods: If your order arrives damaged or defective, please contact us at info@andersonhousefoods.com within seven (7) days of delivery. We may request a photo of the damaged product. Upon verification, we will offer a replacement or a refund at our discretion.
  • Shipping Delays: We are not responsible for delays caused by shipping carriers (UPS/FedEx/USPS), weather, or events beyond our control.
  1. Subscription Services (Auto-Ship)

If you enroll in our Subscription or "Subscribe & Save" program:

  • Automatic Renewal: You acknowledge that your subscription has an initial and recurring payment feature, and you accept responsibility for all recurring charges prior to cancellation.
  • Cancellation: You may cancel your subscription at any time by logging into your account or emailing us. You must cancel at least 24 hours before your next scheduled shipment to avoid being charged for that shipment.
  1. Prohibited Use and Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these terms.

  • Copyright: All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, is the property of K.M.J. Enterprises, Inc. and/or its suppliers and is protected by copyright and other laws.
  • No Resale: You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site.
  1. SMS/Mobile Marketing

By consenting to Anderson House Foods’ SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of us through your wireless provider to the mobile number you provided. Text and data rates may apply. You can opt-out at any time by texting "STOP".

  1. Limitation of Liability (Read Carefully)

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL K.M.J. ENTERPRISES, INC. AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE. OUR MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT IN QUESTION.

  1. Indemnification

You agree to indemnify, defend and hold harmless K.M.J. Enterprises, Inc., its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, your violation of any terms of this Agreement, or your violation of any applicable laws, rules or regulations.

  1. Governing Law, Venue, and Class Action Waiver
  • Governing Law: This agreement is governed by the laws of the State of Illinois, without regard to its conflict of laws principles.
  • Venue: You hereby consent to the exclusive jurisdiction and venue of courts in Lake County, Illinois, or the United States District Court for the Northern District of Illinois, in all disputes arising out of or relating to the use of the Site.
  • Class Action Waiver: You agree that you may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.
  1. Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, acts of God, pandemics, strikes, or shortages of raw materials.

  1. Changes to Terms

We reserve the right, in our sole discretion, to change the Terms under which the Site is offered. The most current version of the Terms will supersede all previous versions. We encourage you to periodically review the Terms to stay informed of our updates.
